Alcon – Olopatadine – Apotex – 5641805

Alcon/Novartis announced that they won the patent infringement case of 5,641,805 against Apotex in the US District Court for the Southern District of Indiana and the product is Patanol (olopatadine hydrochloride ophthalmic solution).

The case-involved was filed on Nov 2006 (insdc06cv1642) at Indiana Southern District Court. Patent in suit was US patent number 5,641,805 (expires on Dec 6, 2015). This ‘805 patent is listed for two products (PATANOL, PATADAY).

The ‘805 patent is related to method for stabilizing mast cell with  olopatadine for treating allergy.

Apotex was the first to file ANDA applicant for this product. As per FDA Paragraph IV information, the first ANDA was filed on July 2006 and Alcon sued apotex on Nov 2006. The subsequent ANDA filers may be Wockhardt, Barr & Sandoz.

    A patent is referred to a set of rights granted to an individual or business by the state that gives them public disclosure of a new invention for a specific amount of time. This grant does not actually give the holder the exclusive right to practice the invention, but simply the right to preclude other outside parties from using or imitating it. Patent Litigation is a controversy or disagreement between two independent parties regarding a dispute of intellectual or physical property.
